Terms of Service

JaxHomes provides home listing browsing, preference learning through TRAViS (Taste Recognition, Analysis and Visual Intelligence System), saved searches and alerts, valuation estimates, and Design Studio remodeling visualization. Access is sponsored by a participating licensed real estate brokerage, which is identified in the app and is responsible for the brokerage relationship with you.

You must be at least 18 years old and able to form a binding contract to use JaxHomes.

• Provide accurate information and keep your sign-in credentials confidential.
• You are responsible for activity under your account.
• One person per account; do not share accounts or access credentials.
• We may suspend or end access for misuse, fraud, or violation of these terms, with notice where practicable.

Listing data comes from multiple listing services and third-party sources and may be delayed, incomplete, or contain errors. Availability, price, and status of any home must be confirmed with the listing brokerage. All listing information is deemed reliable but not guaranteed.

Valuation estimates and net-proceeds illustrations are automated, data-driven opinions for informational purposes only. They are not appraisals, not broker price opinions, and not a substitute for a licensed appraiser, and they should not be relied on as the sole basis for a financial decision. Design Studio visualizations are illustrative concepts, not architectural or construction plans.

TRAViS match predictions are probabilistic. A high or low match score is not a representation that you will like or dislike any particular home.

• Text alerts are optional and sent only after your express opt-in consent. Consent is not a condition of using the service or of any purchase.
• Message frequency varies with the alerts you enable. Message and data rates may apply.
• Reply STOP to opt out at any time; reply HELP for help. You can also manage messaging preferences in your account or by emailing privacy@jaxhomes.com.
• We operate the program in compliance with the TCPA, CTIA guidelines, and carrier A2P (10DLC) registration rules. Carriers are not liable for delayed or undelivered messages. Your mobile information is never sold or shared with third parties for marketing.

• Use the service only for personal, lawful home-shopping purposes.
• Do not scrape, bulk-download, or republish listing data, preference models, or other users’ information.
• Do not upload content you do not have rights to, or that is unlawful or harmful.
• Do not probe, disrupt, or reverse-engineer the service, or access accounts or data that are not yours.

The service, including TRAViS and its preference models, the JaxHomes and TRAViS names and marks, and all site content other than MLS listing data and your own uploads, is the property of ForSaleByPlus, LLC and its licensors. TRAViS is the subject of a pending U.S. provisional patent application.

You retain ownership of photos and content you upload, and grant us a limited license to store, process, and display them to operate the features you use (such as valuation and Design Studio). We do not use your uploads for any other purpose without your permission.

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and accuracy of listing or valuation data.

To the maximum extent permitted by law, ForSaleByPlus, LLC and its sponsoring brokerages are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us for the service in the twelve months before the claim (or $100 if you paid nothing).

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us and try to resolve the dispute informally for at least 30 days. Any unresolved dispute will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction.

We may update these terms; material changes will be announced in the app or by email before they take effect. Continued use after the effective date means acceptance.
